Go Farms Club Membership Terms and Conditions

These Membership Terms and Conditions govern access to and purchases from Go Farms Club. By checking the box indicating agreement at checkout, the customer agrees to be bound by these Terms, the applicable product disclosures shown on the website, and the posted refund policy, if any.

Eligibility and Scope

Go Farms Club offers direct-to-consumer sales of farm products to individual customers in selected service areas in Manhattan and Brooklyn, New York. Orders may be placed through the website and may also be placed in person at events, fairs, or similar sales settings when accepted by Go Farms Club.

Go Farms Club sources products directly from farms in Pennsylvania and resells those products to customers. Product availability is limited by season, farm supply, transportation, and delivery capacity.

Membership Requirement

An active annual membership is required to place an order through Go Farms Club. Membership provides access to purchase products made available by Go Farms Club, but it does not guarantee product availability, inventory levels, delivery dates, or access to any specific item.

Membership is a commercial access program for shopping through Go Farms Club. Membership does not change the legal status of a customer, does not waive rights that cannot be waived by law, and does not place transactions outside otherwise applicable law.

Ordering

Orders are offers to purchase products subject to acceptance by Go Farms Club. An order is accepted only after payment is successfully processed and Go Farms Club confirms the order.

Because products are sourced from farms after customer orders are collected, listed items may become unavailable, delayed, or limited in quantity. If an item cannot be fulfilled, Go Farms Club may cancel that item and issue a refund for the unavailable item.

Product Information

Go Farms Club offers farm products including dairy, eggs, poultry, honey, produce, fruit, berries, soaps, and oils, subject to availability. Product descriptions may identify factual product characteristics such as pasteurized, creamline, not homogenized, pasture-raised, cage-free, farm fresh, seasonal, direct from farms, or sourced from partner farms only to the extent those descriptions are accurate and supported by supplier information or internal records.

Product descriptions are provided for general informational purposes. Variations in size, color, texture, taste, cream separation, shell color, yolk appearance, ripeness, and seasonal condition are normal for farm products and do not by themselves indicate a defect.

Food Safety and Handling

Many products sold by Go Farms Club are perishable and require prompt refrigeration, freezing, or other proper storage after delivery or pickup. The customer is responsible for inspecting the order at the time of receipt and for storing products appropriately after receipt.

Risk of loss and responsibility for the products pass to the customer upon delivery to the customer or the customer’s authorized recipient at the delivery location provided with the order. If products are damaged, spoiled, or not delivered before receipt by the customer, Go Farms Club may, at its option, replace the affected item or issue a refund for that item.

Delivery Area

Go Farms Club currently offers delivery only within selected ZIP codes in Manhattan and Brooklyn, New York, as designated by Go Farms Club from time to time. Orders submitted for addresses outside the then-current delivery area may be declined or canceled.

Raw Milk for Pets Only

If Go Farms Club offers any product identified as raw milk for pets only, that product is offered only as labeled and only in accordance with applicable restrictions. Such products are not offered by Go Farms Club for human consumption through these Terms.

No Medical or Health Claims

Products sold by Go Farms Club are food and related farm goods. Unless expressly stated otherwise in compliant product labeling, descriptions on the website are not intended as medical advice and should not be interpreted as claims to diagnose, treat, cure, mitigate, or prevent disease.

Returns, Replacements, and Refunds

If a product is not delivered, is delivered in damaged condition, or is spoiled before receipt by the customer, Go Farms Club may provide a replacement or refund for the affected item. Any broader return or refund rights are governed solely by the refund policy then posted by Go Farms Club, if any.

Limitation of Liability

To the fullest extent permitted by applicable law, Go Farms Club is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to membership, website use, ordering, delivery, or products purchased through Go Farms Club. To the fullest extent permitted by applicable law, the total liability of Go Farms Club for any claim relating to a product or order will not exceed the amount paid for the specific product or order giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Changes to Products and Terms

Go Farms Club may update product offerings, delivery areas, product descriptions, and these Terms from time to time. Updated Terms apply to future orders after they are posted and accepted through the checkout process.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.
